An order to transfer a case against Shashi Weerawansa

The Court of Appeal has ordered that the case pending before the Colombo Chief Magistrate's Court against Mrs. Shashi Weerawansa, the wife of Member of Parliament Wimal Weerawansa, be transferred to another magistrate.

After considering an application submitted by Mrs. Shashi Weerawansa, this order was issued by the President of the Court of Appeal, Mr. Justice Nishanka Bandula Karunaratne.

Accordingly, after summoning the concerned Nuwa before the Colombo Chief Magistrate tomorrow (12), it was ordered to transfer the number two in that court to the Magistrate's Court.

President's lawyer Nalin Ladduwahetti, who appeared for the petitioner Mrs. Shashi Weerawansa, presented the facts before the court and said that a trial will be held before the Colombo Chief Magistrate regarding the violation of the Immigration and Emigration Act against her client and that she will not get justice in that case.

Pointing out that the Magistrate was prepared to hear this case even when he was sick, the President's Counsel stated that his client has requested the court to transfer the case to another court as she has doubts that she will not get justice.

The Deputy Solicitor General Dilipa Peiris, who spoke before the court regarding the request, said that various measures are being taken by the magistrates to make the trials more efficient.

The Deputy Solicitor General also requested to issue appropriate orders in relation to such incidents if any problematic situation arises.

After considering the facts presented, this order was issued by the President of the Court of Appeal.

நாடாளுமன்ற உறுப்பினர் விமல் வீரவன்சவின் மனைவி திருமதி ஷஷி வீரவன்சவுக்கு எதிராக கொழும்பு பிரதான நீதவான் நீதிமன்றில் நிலுவையில் உள்ள வழக்கை வேறு நீதவானுக்கு மாற்றுமாறு மேன்முறையீட்டு நீதிமன்றம் உத்தரவிட்டுள்ளது.

திருமதி ஷஷி வீரவன்ச சமர்ப்பித்த விண்ணப்பத்தை பரிசீலித்த மேன்முறையீட்டு நீதிமன்றத்தின் தலைவர் நீதியரசர் நிஷங்க பந்துல கருணாரத்னவினால் இந்த உத்தரவு பிறப்பிக்கப்பட்டுள்ளது.

இதன்படி, குறித்த நுவாவை நாளை (12) கொழும்பு பிரதான நீதவான் முன்னிலையில் வரவழைத்ததன் பின்னர், அந்த நீதிமன்றில் உள்ள இலக்கம் இரண்டை நீதவான் நீதிமன்றத்திற்கு மாற்றுமாறு உத்தரவிடப்பட்டது.

மனுதாரர் திருமதி ஷஷி வீரவன்ச சார்பில் ஆஜரான ஜனாதிபதியின் சட்டத்தரணி நளின் லட்டுவாஹெட்டி, நீதிமன்றில் உண்மைகளை முன்வைத்து, தனது கட்சிக்காரருக்கு எதிரான குடிவரவு மற்றும் குடியகல்வு சட்டத்தை மீறியமை தொடர்பில் கொழும்பு பிரதான நீதவான் முன்னிலையில் விசாரணை நடத்தப்படும் எனவும் தெரிவித்தார். அந்த வழக்கில் நீதி கிடைக்காது.

நீதவான் நோய்வாய்ப்பட்டிருந்த போதும் இந்த வழக்கை விசாரிப்பதற்கு தயாராக இருப்பதாக சுட்டிக்காட்டிய ஜனாதிபதி சட்டத்தரணி, தனக்கு நீதி கிடைக்காது என்ற சந்தேகம் உள்ளதால், வழக்கை வேறு நீதிமன்றத்திற்கு மாற்றுமாறு தமது தரப்பு நீதிமன்றத்திடம் கோரிக்கை விடுத்துள்ளதாகவும் குறிப்பிட்டார்.

இக்கோரிக்கை தொடர்பில் நீதிமன்றில் முன்னிலையாகிய பிரதி சொலிசிட்டர் ஜெனரல் திலிப பீரிஸ், வழக்கு விசாரணைகளை வினைத்திறனுடன் நடத்துவதற்கு நீதவான்களால் பல்வேறு நடவடிக்கைகள் மேற்கொள்ளப்பட்டு வருவதாக தெரிவித்தார்.

ஏதேனும் பிரச்சினையான சூழ்நிலை ஏற்படுமாயின் அவ்வாறான சம்பவங்கள் தொடர்பில் உரிய உத்தரவுகளை பிறப்பிக்குமாறும் பிரதி சொலிசிட்டர் ஜெனரல் கேட்டுக்கொண்டார்.

முன்வைக்கப்பட்ட உண்மைகளை பரிசீலித்ததன் பின்னர், மேன்முறையீட்டு நீதிமன்றத் தலைவரினால் இந்த உத்தரவு பிறப்பிக்கப்பட்டுள்ளது.
